English Addicts - TERMS OF SERVICE

I.         REGISTRATION

English Addicts is a service offered by Edulang - Rue Yves Guyader - ZA de La Boissière - 29600 MORLAIX - FRANCE, registered as a business under the number B387 718 406 00037 in Morlaix.
Edulang is a publisher of language learning software.

Article 1 - Definitions

  • User: any individual or legal entity who has registered to use English Addicts and has access to the English Addicts Web service.
  • English Addicts and English Addicts Web: software created and supplied by Edulang.
  • Service: access to the English Addicts lessons. The service currently available publishes a new daily lesson from Monday to Friday, from the end of September to the end of June (the service is suspended in July and August). Lessons may not be available at other times due to unforeseen circumstances, technical breakdown or general maintenance required to ensure the continuity of the service.

Article 2 - Subject

The following articles define the conditions and terms of service which apply to the use of English Addicts.
Registering to use English Addicts enables the user to access a limited number of lessons made available by Edulang free of charge. A subscription to English Addicts allows the user to access further lessons for a requested period of time (see section II. below)
User rights with respect to the terms presented here are personal and non-transferable.

Article 3 - Conditions of access to the service

The user registers online to use the service and creates a login and a password. The login and password are personal and confidential. The user is solely responsible for their safeguard and use. The user promises to keep them in a safe place and not to supply them to any third party. All connections to the English Addicts Web service made using this login will be recorded as being carried out by the user himself or a person under his responsability.
In the case of the password being lost - the user should use the "Lost password" link on the English Addicts.com website.

Article 4 - Responsibilities

The responsibility of Edulang is limited to ensuring the availability of the English Addicts Web service.
Edulang may not be held responsible for the unavailability of the user's Internet connection resulting from a failure on the part of the user's Internet provider.

Article 5 - Validity of the Contract

The contract is valid from the date that the user registers to use the service.
The user is subject to the present conditions as long as the login remains valid.

Article 6 - Assistance

Edulang undertakes to reply to the best of its ability to any valid requests for assistance. However, Edulang is under no obligation to find a final solution to any request for assistance. Assistance is given to users by email and it is understood that the cost of the Internet connection is paid for by the user. The user undertakes to supply his personal details and login in order for Edulang to examine any request.

Article 7 - Confidentiality

Edulang undertakes not to divulge to third parties any information supplied in connection to the subscription to the English Addicts service. This information is strictly confidential and will only be used to process the subscription and to keep subscribers regularly informed about Edulang's products and services.

Article 8 - Litigation

These terms are subject to French law. In case of dispute the competent courts to deal with matters relating to the terms of sale are those of the head office of Edulang, in this case: Morlaix, France.

II.         SUBSCRIPTION

On receipt of the online subscription and payment, Edulang will activate the type of service requested. The subscription will commence as soon as the subscription and payment confirmation are received.
The user undertakes to communicate correct information to Edulang and the conditions described above concerning the login and password still apply.
The price of the subscription is payable in advance and is non-refundable.
Access to the service will terminate automatically according to the type of subscription requested.

The English Addicts service requires a computer with an Internet connection that must remain valid as long as the subscription to English Addicts is maintained. The price of the English Addicts service does not include the price of a subscription to the Internet.

For its English Addicts service Edulang makes use of the news reports of Voice of America, which are public domain. Edulang may not be held responsible for the temporary interruption of English Addicts News if Voice of America ceases to publish its reports as public domain. In the case where Edulang is unable to continue to use these reports, Edulang is authorised to interrupt its service for a limited period of time. Edulang undertakes to make every effort to find a new source of appropriate news reports that can be legally exploited by English Addicts. The length of the user's subscription will be prolonged at no extra charge to correspond to the period of interruption to the service. As a result Edulang will not be liable for any further compensation, claims, or reimbursement of any kind on the part of the users.

It is expressly agreed that if the responsibility of Edulang is upheld in the execution of its service, the user may not claim reimbursement of any sum over and above the amount paid for the subscription already paid by the user.
